Experience
Ken began his career after being offered articles at one of Australia’s most oldest and well-respected firms. He later moved on to establish his own legal practice and subsequently
co-founded Bennett & Philp with Tony Bennett in 1986. He has been instrumental in building and developing Bennett & Philp’s Intellectual Property department into one of the firm’s most noted areas of practice.
Ken currently specialises in Intellectual Property law, dealing with domestic and international disputes on a regular basis. His extensive portfolio includes providing advice on trade mark infringement, copyright enforcement and derived rights, patents, designs, passing off, computer hardware and software, computer systems and networks, brand protection, protection of confidential information, new technology including R & D collaborations and licensing.
Ken acts for a range of local, interstate and international clients including trade suppliers, property developers, financiers, patent and trade mark attorneys, large commercial entities and private individuals.
Ken has successfully litigated a number of high profile cases before the High Court over the past two decades, some with significant decisions. He has represented clients in major patent cases before the Supreme Court and Federal Court including obtaining the landmark decision in C Com Pty Ltd v Jiejing Pty Ltd (1993) 27 IPR 133.
Ken also practices in the areas of commercial litigation, contract law, competition law and trade practices law. His experience in these sectors enables him to take a multi-jurisdictional approach to disputes and provide clients with advice that is not only legally accurate but commercially astute.
