The Team draw disclosure documentation that complies with the Franchising Code of Conduct (Code) as prescribed under the Competition and Consumer Act 2010 (Cth). The Code is prescriptive and accordingly much care and legal expertise needs to be applied to ensure that the disclosure document fully complies with the Code.
We also advise franchisees on whether the disclosure documentation in their agreements meets the requirements of the Code and if not, in what manner the documentation is deficient.
At the early stages of negotiation and documentation vetting, we draw upon our Team's depth of franchise industry knowledge and experience to advise both the franchisor and the franchisee. We provide advice to clients on franchisor/franchisee relationships and in some instances demonstrate to clients that the franchise agreement is too one-sided, that they should not proceed until the agreement is perfected through significant recasting.
